New Fire Marshal Representative Election Dates

The current Collective Bargaining Agreement (CBA) between the UFA and the City will expire on July 31, 2010. This is the same day the term of office for the Fire Marshal Representative expires. As a result, the UFA Constitution requires a modification of the timing of the next Fire Marshal Representative election. Article V, Section 2, states that when terms of office expire in the same year that the Collective Bargaining Agreement is scheduled to expire, those current terms expire three (3) months earlier (April 30th instead of July 31st). Thus, the election process changes as follows:

(a) Article VI, Section 1, states that in this case, the nomination meeting shall be held in "whichever month occurs six months prior to the month in which the collective bargaining agreement is scheduled to expire." Since the CBA expires on July 2010, six months earlier would require that the nomination meeting take place in January 2010. Nominations will take place at the January 7 Union Meeting (at Terrace on the Park, Queens);

(b) Candidate petitions with 15 signatures of active Fire Marshals must be submitted to the Recording Secretary by Wednesday, December 30, 2009 (Article VI, Section 1);

(c) Just as in normally timed elections, the ballots will be mailed no less than 14 days before and no more than 21 days after nominations (Article VI, Section 3). The ballots will be mailed on Thursday, January 21;

(d) Ballots will be counted on Friday, February 5 by the American Arbitration Association with UFA Election Committee oversight; and

(e) The new Fire Marshal Representative will take office on May 1, 2010 [Article V, Section 2, and Article VI, Section 3(b)].
